im looking to get ios 4.0 on my itouch and i think i have an XP is there any way i can download it, like a way to trick itune. or a windows vista or 7 download for free, thanks.

Why and how is "tricking" your computer important? If this is software that comes from Apple you should be able to get it through iTunes finedownload itunes 7 for vista, and what kind of computer you are using should have no effect on it. I have iTunes on my Windows 7 and it's working just fine. If you're looking for something else, be a bit clearer, please.
